1. Acceptance of Terms

By accessing or using the Cloakly application and website, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.

2. License to Use

Subject to your compliance with these terms, Cloakly grants you a limited, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the application on your personal devices for personal or internal business use.

3. Prohibited Uses

You agree not to use the service:

• In any way that violates applicable law or regulation.
• To exploit, harm, or attempt to exploit or harm minors.
• To transmit unsolicited advertising, spam, chain letters, or similar solicitation.
• To impersonate the company, its employees, or other users.
• To engage in conduct that restricts or inhibits another person’s use of the service.

4. Intellectual Property

The service and its original content, features, and functionality remain the exclusive property of Cloakly and its licensors, and are protected by copyright, trademark, and related laws.

5. Termination

We may terminate or suspend access immediately, without prior notice or liability, for any reason including breach of these terms. Upon termination, your right to use the service ceases immediately.

6. Limitation of Liability

In no event shall Cloakly, its directors, employees, partners, agents, suppliers, or affiliates be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses arising from use of the service.

7. Changes to Terms

We may modify or replace these terms at any time. For material revisions, we will make reasonable efforts to provide at least 30 days’ notice before updated terms take effect.

8. Enforcement and Privacy

Cloakly is privacy-first and local-only. We do not monitor your screen, keystrokes, or window contents. Because of that architecture, technical enforcement of all prohibited-use scenarios is limited, but we reserve the right to investigate abuse reports and terminate access if violations are discovered by other lawful means.
